This week, we begin our read of the second book in the course, Justice Neil Gorsuch’s book, A Republic, If You Can Keep It. In the chapters assigned this week, Gorsuch lays out the basic elements of his judicial philosophy, and discusses it in the context of several cases he deems important.

 

For the DB this week, please respond to the following:

 

1. Please comment broadly on Gorsuch’s judicial philosophy, as he expresses it in Chapters 1-2 of the book, and in the talk I have also asked you to read. Please comment specifically on his articulation of the role of judges, as opposed to legislators and executive leaders. What aspects of his view do you agree/disagree with? Please explain your answer.

 

2. Please pick one case covered in Chapter 2 (Gutierrez-Brizuela, Caring Hearts, Nichols, and Dimaya). Please comment on how Gorsuch interprets the case and how it should be/was decided. What aspects of his analysis do you agree/disagree with, and why?
