The Drug-Free Workplace Act of 1988 is a federal law; generally, the federal government can create laws, however, states have the power to enforce or not enforce certain laws. For example, over two dozen states have passed laws permitting some degree of personal and/or medical marijuana use, although marijuana remains a listed and prohibited controlled substance under the Drug-Free Workplace Act. Please respond to the following:

  1. Provide examples of how some drug use might be permitted under state law.
  2. In cases where state law permits some degree of use of marijuana, how would federal and state law be applied in the workplace?
  3. Reflect on the items you've covered in this week's studies and your past professional experience to provide examples of the general differences in Federal versus State health and safety laws.
  4. Please provide your general opinion: how little is too little, or how far is too far as it relates to federal or State health and safety laws?
